The alleged fraud by Michael Sebaduka Mwebe was neither pleaded nor litigated in the original suit, and review cannot be used to re-litigate matters requiring evidence. The applicants had knowledge of the alleged fraud since 2009 but took no action until 2023, undermining their claim of newly discovered evidence and indicating bad faith.
