Ratio Decidendi

The court found that the Administrator General, having obtained a grant of Probate/Administration of the estate, is the only competent person to bring a suit concerning the estate property. The plaintiff, as a beneficiary with a succession certificate, does not have legal standing to institute the action until the Administrator General has dealt with the property in accordance with the law. Section 264 of the Succession Act expressly bars any person other than the holder of Probate or Letters of Administration from suing or acting as representative of the deceased. The suit was therefore not maintainable and was struck out with costs.
