The court held that the notice of motion, being a suit for purposes of service, was subject to the provisions of Order 5 Civil Procedure Rules, which require service within 21 days of issue unless an extension is sought within 15 days after expiration. In this case, service was effected nearly nine months after filing, and no application for extension was made. The delay was not excusable as a mere technicality under Article 126(2) of the Constitution, and the applicant, having instructed counsel, bore responsibility for the failure to comply with the rules. Consequently, the application was bad in law and dismissed with costs to the respondent.
