[2017] UGHCLD 109

The LC II court of Girigiri, which rendered its decision on 24 November 2007, was not legally constituted at the time, as its members' elective term had expired following constitutional amendments. Consequently, the court lacked jurisdiction to determine the land dispute, and its judgment is a nullity. All subsequent orders and enforcement actions based on that judgment, including those by the Chief Magistrate, are also nullities and are set aside. The parties are free to institute fresh proceedings before a court of competent jurisdiction.
