The appeal succeeded because the evidence established that the 1st Appellant was the rightful owner of the suit land, having received it as a gift from her father. The 2nd Appellant, who sold the land to the Respondents, did not have title to the suit land and therefore could not transfer valid ownership. The trial Magistrate erred in upholding the sale to the Respondents. The 3rd Appellant was wrongly joined as a party, as he merely witnessed the transaction in his official capacity and was protected by judicial immunity.
