The court found that the National Drug Policy and Authority Act establishes the National Drug Authority as a statutory body composed of members, some of whom are appointed by the Minister. The Act does not confer upon the Minister the power to dissolve the Authority or any so-called 'board.' The Minister's letter purporting to dissolve the 'board' was ultra vires, as the law only allows the Minister to appoint and remove certain members, not to dissolve the entire Authority.
