The court found that Rule 5 of the Judicature Court of Appeal Rules expressly vests such jurisdiction in the Court of Appeal. The applicant's reliance on Section 96 of the Civil Procedure Act was misplaced, as that provision is only applicable when the High Court is acting as an appellate court, which was not the case here.
