Ratio Decidendi

The court held that while amendments to the written statement of defence are permissible to allow the inclusion of omitted facts and to facilitate the determination of the real issues in controversy, the introduction of a counterclaim by way of amendment is not permissible where no counterclaim was pleaded in the original defence. The applicant should have sought leave to file a counterclaim out of time rather than attempt to include it through amendment. The application to amend the written statement of defence is allowed only to the extent of adding omitted facts, but the proposed counterclaim is denied. Costs are to be in the cause.
