[2017] UGHCFD 12

The trial magistrate erred in law by dismissing the divorce cause for lack of jurisdiction to dissolve a customary marriage, despite having already issued a decree nisi based on both parties' consent. Courts have jurisdiction to dissolve customary marriages, and the proper procedure after issuance of a decree nisi is to resolve outstanding issues such as distribution of matrimonial property. The dismissal constituted a material irregularity warranting revision. The High Court set aside the dismissal, reinstated the divorce cause and decree nisi, and ordered the trial court to proceed with determination of property distribution.
