However, the court found that there was good cause to set aside the default judgment because the main suit raised a triable issue regarding the enforceability of a contractual default interest rate of 10% per day, which appeared harsh and unconscionable. The court held that Section 26(1) of the Civil Procedure Act empowers it to refuse to enforce such an interest rate if it is not a genuine pre-estimate of damages.
