Procedural Posture

Revision Cause / Ruling on Application for Revision

  1. 1 Whether sufficient grounds exist for the revision of the ruling, judgment, orders and decree in Civil Suit No. 12 of 2021 of the Chief Magistrates Court of Wakiso at Kakiri.
  2. 2 Whether the Chief Magistrate's Court had pecuniary jurisdiction to determine the suit involving land valued above UGX 20,000,000.

Ratio Decidendi

The High Court found that the Chief Magistrate's Court lacked pecuniary jurisdiction to determine the suit, as the value of the subject land exceeded the statutory limit of UGX 20,000,000 for that court. The trial magistrate erred by overruling the objection to jurisdiction and proceeding to judgment. The prayer for eviction and the issue of proprietary interests placed the matter outside the lower court's jurisdiction. The application for revision was therefore merited, and the orders, judgment, and decree of the lower court were set aside for want of jurisdiction.

Court Disposition

application allowed; lower court judgment, orders, and decree set aside for want of jurisdiction

Orders

  • The ruling, judgment, orders and decree in Civil Suit No. 12 of 2021 of the Chief Magistrates Court of Wakiso at Kakiri are hereby revised and set aside for want of jurisdiction.
  • Each party to bear its own costs.
