The court found that the applicants failed to act diligently after filing the suit, waiting nearly a year before taking further steps. Although the applicants claimed non-service of the WSD, they did not bring this to the court's attention or apply to set the matter down for hearing as permitted by the rules. The court held that the applicants' inaction defeated the purpose of the amended rules intended to expedite proceedings. However, recognizing that the law allows for reinstatement of a suit that has abated, and that requiring the applicants to file a fresh suit would be inefficient, the court exercised its discretion to allow reinstatement, subject to payment of costs to the respondent.
