The Defendants breached the agreement for sale of land by failing to transfer possession or title to the Plaintiff after full payment, and by failing to take any steps to complete the survey or mutation process. The existence of a court case and injunction over the land, and the subsequent loss of the land to a third party, rendered the Defendants unable to perform their obligations under the contract. The Plaintiff is entitled to a refund of the purchase price, general damages for economic inconvenience and mental anguish, and interest at commercial rates, as the Defendants kept her out of the use of her money and failed to deliver the land as promised.
