The only medical report provided was outdated, did not state that the defendant was incapable of managing his affairs, and appeared to have been prepared for a different purpose. There was no court or board determination of incapacity as required by the Mental Health Act. Consequently, the applicant failed to establish sufficient grounds for appointment as guardian ad litem, and the related request for extension of time to file a defence also failed.
