Ratio Decidendi

The Grade One Magistrate's Court lacked pecuniary jurisdiction to entertain Misc. Cause No. 293 of 2022, as the claim for UGX 24,000,000 exceeded the statutory limit of UGX 20,000,000. Jurisdiction must exist at the time of filing suit or commencement of hearing and cannot be conferred retroactively. Orders made without jurisdiction are a nullity ab initio. The High Court, exercising its powers under Section 83 of the Civil Procedure Act, found that the Magistrate exercised jurisdiction not vested in law, rendering the ruling and orders a nullity. The application for revision succeeds, and the matter is to be heard de novo by a competent Chief Magistrate. Each party is to bear its own costs.
