Ratio Decidendi

Where the donee of a Power of Attorney and the mortgagee cannot be traced, the High Court may invoke its inherent and discretionary powers to allow the donor to discharge the loan obligations incurred by the donee, deposit the loan amount with the court for safe keeping, and direct the Registrar of Titles to issue a Special Certificate of Title and vacate any caveat registered pursuant to the equitable mortgage. The absence of the Respondents and the Applicant's readiness to pay the loan amount, coupled with the inability to retrieve the title due to the Respondents' unavailability, justifies the court's intervention to resolve all matters and avoid multiplicity of proceedings.

  • The Applicant shall pay UGX 6,000,000 to the Deputy Registrar (Land Division) for safe keeping until the 1st Respondent appears and claims the same.
