Ratio Decidendi

The application was fatally defective because the supporting affidavit was sworn by a beneficiary, not the administrator, contrary to the law which requires the administrator to personally swear affidavits in proceedings concerning the estate. The administrator cannot delegate this responsibility. The application also failed to comply with procedural requirements regarding service of process and was based on irreconcilable legal provisions. As a result, the affidavit was struck off, leaving the application unsupported by evidence, and the application was dismissed. The consolidation of related suits was acknowledged, but did not cure the procedural defects in the instant application.
