The court found that although the respondent's memorandum of appeal was filed three days out of time, the delay was occasioned by prompt application for the record of proceedings and subsequent delay by the court in availing the certified copy. The mistake of counsel in computing the last day for filing should not be visited upon the respondent. Under section 79(1) of the Civil Procedure Act, the court has discretion to admit an appeal out of time for good cause, and the interests of substantive justice require that genuine claims are not defeated by technicalities.
