Procedural Posture

Miscellaneous Application / Ruling

  1. 1 Whether the application for stay of execution of orders in Miscellaneous Application No. 13 of 2023 should be granted.

Ratio Decidendi

The court found that the Applicants were in contempt of previous court orders regarding a joint boundary survey, which were agreed upon by both parties. The Applicants failed to purge their contempt by not making the required deposit or showing remorse. Filing an appeal or an application for stay does not purge contempt. The court held that a contemnor cannot enjoy audience before the court in related matters until the contempt is purged. Granting the stay would encourage contemptuous conduct and undermine the authority of the court. Therefore, the application for stay of execution was dismissed without consideration of its merits, and costs were awarded against the Applicants.
