The court found that although the respondents' written statement of defence was filed out of time, the delay was attributable to a genuine mistake regarding the identity of the respondents' instructed advocates. The applicants' process server, acting on the respondents' advice, served the summons on M/s Eric-Kiingi & Co. Advocates, who were not instructed to represent the respondents. The respondents' actual lawyers, M/s Barnabas D. K Dyadi & Co. Advocates, only became aware of the suit in February 2024 and filed the defence promptly thereafter.
