Ratio Decidendi

The applicant failed to prove, on the required standard, that the consent judgment was tainted by collusion, misapprehension, illegality, or error. The evidence presented did not meet the threshold for setting aside a consent judgment, as allegations of collusion and fraud must be strictly proved and are best addressed through an ordinary suit rather than a motion. The mere fact that the 5th respondent entered into a consent with the plaintiffs does not amount to actionable collusion or fraud, nor does it stifle the applicant's right to be heard, as the suit against her still subsists. The application was found to be without merit and was dismissed.
