The African Court on Human and Peoples' Rights manifestly lacks jurisdiction to entertain the application brought by CONASYSED against the Republic of Gabon. This is because CONASYSED does not possess observer status before the African Commission on Human and Peoples' Rights, and the Republic of Gabon has not made the declaration required under Article 34(6) of the Protocol, which is a prerequisite for the Court to receive applications from NGOs and individuals. The absence of both observer status and the optional declaration by Gabon renders the application inadmissible and outside the Court's jurisdiction. Accordingly, the application must be struck out.
