Criminal Appeal / Final Judgment

  1. 1 Whether the appellant was positively identified as the perpetrator of aggravated defilement.
  2. 2 Whether the sentence imposed by the trial judge was harsh and excessive.

Ratio Decidendi

The Court of Appeal found that the victim's testimony, corroborated by medical evidence, was sufficient to positively identify the appellant as the perpetrator of aggravated defilement. The relationship between the victim and appellant eliminated the possibility of mistaken identity. Discrepancies in the dates were immaterial, as the victim was residing with the appellant during the relevant period. The trial judge properly considered both aggravating and mitigating factors, and the sentence imposed was within the statutory range for aggravated defilement. There was no basis for appellate interference with either the conviction or the sentence. The appeal was dismissed in its entirety.

Court Disposition

appeal dismissed

Orders

  • The conviction and sentence of 30 years imprisonment (less remand period) for aggravated defilement are upheld.
  • No order as to costs.
