Ratio Decidendi

The court found that a lawful temporary injunction order existed and was delivered in the presence of the 3rd to 5th respondents, establishing their knowledge of the order. The applicant provided evidence that these respondents continued to sell and construct on the suit land, in direct violation of the injunction. The respondents' claims that the land sold was not part of the suit land were unsupported by evidence. The court concluded that the 3rd to 5th respondents knowingly disobeyed the court order and were therefore in contempt. The application succeeded against these respondents, who were ordered to comply with the injunction and pay a fine for contempt.
