The requirement under Order 11A rule 1(2) of the Civil Procedure (Amendment) Rules, 2019 for the plaintiff to take out summons for directions within 28 days from the last reply is mandatory. The respondent/plaintiff failed to comply with this requirement, as no summons for directions were taken out by 15th June 2023 following the filing of the written statement of defence on 18th May 2023. The suit does not fall within any of the exceptional circumstances listed under Order 11A rule 1(4).
