The Court found that while the Applicant's pleadings raised a prima facie issue for Treaty interpretation, she failed to demonstrate irreparable injury that could not be compensated by damages. The Applicant did not provide satisfactory evidence of injury, and her claims were unsupported by documentary proof. The recruitment process was at an advanced stage, and halting it without proof of injury would cause greater inconvenience and injury to the Respondent, who had acted in accordance with directives and discharged its duty. The balance of convenience did not favour the Applicant. The Court therefore disallowed the application for interim orders.
