Ratio Decidendi

The appeal cannot proceed against a deceased respondent unless the legal representative of the deceased is substituted as a party pursuant to Order 24 Rule 4(1) of the Civil Procedure Rules. In this case, although the appellant informed the court of the respondent's death and the existence of Letters of Administration, no formal application was made to substitute the legal representative. As required by Order 24 Rule 4(3), where no application for substitution is made within the time limited by law, the suit abates as against the deceased defendant. Therefore, the appeal abates and cannot be determined on its merits.
