The Court of Appeal found that the respondent failed to prove, to the required standard, the allegations of widespread intimidation of voters by armed men, ballot stuffing, multiple voting, and falsification of Declaration of Results Forms. The court held that the evidence relied upon by the trial Judge was largely partisan and uncorroborated, and that independent evidence was lacking. The only proven irregularity was at Kobukurura polling station, where ballot stuffing was established, but the results from that station were cancelled and did not benefit any candidate.
