Ratio Decidendi

The Court of Appeal found that the circumstantial evidence, including prior threats by the appellant and corroborated confession to PW12, pointed irresistibly to the appellant's guilt for the murder of his grandfather. The confession to the herbalist was properly admitted and corroborated by other evidence. The trial judge correctly evaluated the ingredients of murder and the evidence adduced. However, the sentence of 45 years was deemed harsh and excessive in light of comparable cases and sentencing guidelines. The appellate court held that a sentence of 25 years' imprisonment was appropriate, taking into account the period spent on remand and the aggravating and mitigating factors.
