Ratio Decidendi

The court found that the Plaintiff lawfully acquired the suit land through a judicial sale following execution of a court decree, was duly registered as proprietor, and had no notice of any fraud or irregularity. The Defendant did not plead or prove fraud, nor did she counterclaim. The court held that the Plaintiff was a bona fide purchaser for value and that the certificate of title was conclusive evidence of ownership. The Defendant's entry and construction on the land constituted trespass, as she had no legal right to the property after the execution process. The Plaintiff was therefore entitled to a declaration of ownership, eviction of the Defendant, damages for trespass, and costs.
