[2002] UGSC 14

The Supreme Court found that the contradictions in the prosecution evidence regarding the date of the offence were minor and did not go to the root of the case. The Court held that the date of the offence is not an ingredient of defilement and that the doctor's estimate of the age of injuries was not a material contradiction. The Court further found that the evidence of the complainant, her mother, and the medical report, when considered together, proved penetration beyond reasonable doubt. The Court reaffirmed that even slight penetration suffices for a conviction of defilement. Accordingly, both grounds of appeal failed, and the conviction and sentence were upheld.
