Ratio Decidendi

The court found that while the Respondent had a right to restructure its organization, it failed to follow the proper procedure by not notifying the Claimant about the restructuring before her termination. Although the restructuring itself was lawful and the Claimant's termination was not unlawful, the procedural lapse entitled the Claimant to general damages. The court awarded Ugx. 900,000 as compensation for the Respondent's failure to notify the Claimant prior to the restructuring, but dismissed the remainder of the claim. No order as to costs was made.
