Miscellaneous Application / Ruling on Preliminary Objection to Garnishee Order Absolute

  1. 1 Whether the absence of a date and court seal on Miscellaneous Cause No. 14 of 2014 renders the consent judgment and decree a nullity.
  2. 2 Whether a garnishee order absolute can be made where the underlying consent judgment is challenged as invalid.
  3. 3 Whether a third party (garnishee) can set aside a consent judgment by preliminary objection.

Ratio Decidendi

The court held that the absence of a date and court seal on the originating cause is a mere irregularity and does not render the consent judgment and decree a nullity. Consent judgments are validated by the court under the Civil Procedure Rules and can be recorded at any stage, provided the parties are present and agree. The court distinguished the Hussein Badda case, finding it inapplicable to consent judgments. Furthermore, a third party such as the garnishee cannot set aside a consent judgment by preliminary objection; the proper procedure is by suit or application for review. The preliminary objection was dismissed, and the garnishee order absolute was allowed to proceed.

Court Disposition

preliminary objection dismissed; garnishee order absolute allowed to proceed

Orders

  • Preliminary objection by the garnishee is dismissed.
  • Costs in the cause.
