The High Court found that the estate of the late Beyamya Phillip had been distributed among his beneficiaries during the 1995 family/clan meeting, as evidenced by the minutes and corroborated by witness testimony. The disputed portion of land, approximately ¼ acre, was recognized as belonging to Kabagambe Langton, the Respondents' father, and the boundaries were demarcated by trenches agreed upon by the family. The Appellants' occupation and cultivation of the disputed land constituted trespass, as they had no legal right to the portion allocated to the Respondents.
