The High Court found that although the trial magistrate had jurisdiction to try the matter, she exercised it with material procedural irregularities and illegalities that occasioned injustice to the applicant. Specifically, the record did not show proper appointment of the surveyor, the survey report was handled ex parte against the defendant without an order allowing such proceedings, and the court failed to visit locus in a boundary dispute involving registered land. These failures contravened the requirements of fair hearing and proper procedure under the Civil Procedure Rules.
