Ratio Decidendi

The court found that although the applicants had an automatic right of appeal against the Deputy Registrar's order under Order 50 Rule 8 of the Civil Procedure Rules, Section 79(1)(b) of the Civil Procedure Act required such an appeal to be filed within seven days of the decision. The applicants filed their appeal on 27th November 2024, whereas the Deputy Registrar's decision was delivered on 13th November 2024, well outside the statutory seven-day period. The applicants did not seek leave of court to file the appeal out of time. The court held that an appeal filed outside the prescribed time without leave is a nullity, and any legal process arising from it is also a nullity....
