Ratio Decidendi

The court found that the applicant's failure to file the notice of appeal within time was due to the mistake of his former counsel, whom he had instructed to follow up the case but who failed to inform him of the judgment. The court held that such mistake of counsel constitutes sufficient reason for extension of time, especially where the applicant was not guilty of dilatory conduct.
