Ratio Decidendi

The court found that HCCS No. 38 of 2021 is barred by the doctrine of res judicata in respect of the property comprised in Busiro Block 367 Plot 143 at Mpogo Wakiso District. The issues and parties in the current suit were substantially the same as those in HCCS No. 250 of 2009, Civil Appeal No. 186 of 2012, and Civil Suit No. 224 of 2016, all of which conclusively determined the legality of the transfer and the rights of the parties. The introduction of fraud as a new cause of action did not alter the underlying dispute, which had already been adjudicated. The respondent, while lacking locus standi as manager after the death of John Tebyasa, retained locus as a beneficiary to bring suit...
