Ratio Decidendi

The High Court found that the plaintiff, Foibi Sebisogi, was the rightful owner of the suit land, having only granted a temporary license to her grandson, which ended upon his death. The evidence showed no valid marriage between Dusabe Peter and Mukanjera Imerida, and the purported sale of the land by Imerida to Nzitatira Evarista was invalid, as it was conducted without the involvement of the plaintiff or other immediate family members. The defendants' occupation of the land was therefore unlawful and amounted to trespass. The trial Magistrate's findings were upheld, and the appeal was dismissed for lack of merit.
