Ratio Decidendi

The court held that the purpose of an amendment is to enable justice to be done by properly determining the real questions in controversy. Since the date of receipt of the letter is a central and contested fact in the dispute, it is appropriate for this issue to be included in the main application and tested during the hearing. The respondent will not be prejudiced by the amendment, as they will have the opportunity to challenge the applicant's assertions during the substantive hearing. The application to amend is therefore granted, as it serves the interests of justice and does not cause injustice to the respondent.
