I would think that damages for bereavement should now be recognized or at least taken into consideration when assessing damages for lo \hich\af0\dbch\af12\loch\f0 s\hich\af0\dbch\af12\loch\f0 \hich\f0 s of expectation of life\'94 \par \par }{\dbch\af12\insrsid15470071\charrsid275711 \hich\af0\dbch\af12\loch\f0 This Court is enjoined by Article 126 (2)(e) of the Constitution to administer substantive justice without undue regard to technicalities. \par \par }{\dbch\af12\insrsid10882617\charrsid275711 \hich\af0\dbch\af12\loch\f0 In the plaint, the plaintiff stated he was the father of }{\dbch\af12\insrsid10306750\charrsid275711 \hich\af0\dbch\af12\loch\f0 t}{\dbch\af12\insrsid10882617\charrsid275711 \hich\af0\dbch\af12\loch\f0 he deceased and that he was so \hich\af0\dbch\af12\loch\f0 suing the defendant. The plaint also averred that the foundation of the claim was the unlawful shooting by use of a gun by a UPDF soldier of the deceased at Akor Primary School, Lira District on 17.08.2005. Finally, plaint also clearly state}{ \dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 d}{\dbch\af12\insrsid10882617\charrsid275711 \hich\af0\dbch\af12\loch\f0 that plaint\hich\af0\dbch\af12\loch\f0 iff as father, suffered pain, mental anguish and financial loss and seeks damages by reason thereof. \par \par \hich\af0\dbch\af12\loch\f0 This Court, on the basis of the above averments in the whole body of the plaint, finds that the essential facts that make the plaintiff\hich\f0 \rquote \loch\f0 s claim fall under\hich\af0\dbch\af12\loch\f0 the }{ \dbch\af12\insrsid14430509\charrsid275711 \hich\af0\dbch\af12\loch\f0 L}{\dbch\af12\insrsid10882617\charrsid275711 \hich\af0\dbch\af12\loch\f0 aw}{\dbch\af12\insrsid14430509\charrsid275711 \hich\af0\dbch\af12\loch\f0 Reform (Miscellaneous Provisions) Act, Cap. 79, Laws of Uganda, are stated in the plaint. Therefore the mere absence of the mention of the fact that the plaintiff\hich\f0 \rquote \loch\f0 s claim is under the said Act, cannot be so fatal as to amount to the plaint showin\hich\af0\dbch\af12\loch\f0 g no cause of action. This court, under the constitutional duty to administer substantive Justice, for the reasons given, holds that the plaint shows a cause of action.}{\dbch\af12\insrsid15470071\charrsid275711 \par }{\dbch\af12\insrsid14430509\charrsid275711 \par }{\dbch\af12\insrsid11221321\charrsid275711 \hich\af0\dbch\af12\loch\f0 The answer to the first issue is that the plaintiff\hich\f0 \rquote \loch\f0 s suit is properly before this co\hich\af0\dbch\af12\loch\f0 urt.}{ \dbch\af12\insrsid14430509\charrsid275711 \par }{\dbch\af12\insrsid11221321\charrsid275711 \par \hich\af0\dbch\af12\loch\f0 As to the second issue, the evidence of PW1: Acuma Denis, PW2: Ajok D}{\dbch\af12\insrsid5588218\charrsid275711 \hich\af0\dbch\af12\loch\f0 o}{\dbch\af12\insrsid11221321\charrsid275711 \hich\af0\dbch\af12\loch\f0 rcus, PW3 }{ \dbch\af12\insrsid5588218\charrsid275711 \hich\af0\dbch\af12\loch\f0 O}{\dbch\af12\insrsid11221321\charrsid275711 \hich\af0\dbch\af12\loch\f0 dong Cypriano, and PW4 Dr. Okello Terence, which evidence was not rebutted by any defence evidence}{ \dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid11221321\charrsid275711 \hich\af0\dbch\af12\loch\f0 for defence called no witness, established on a balance of probabilit\hich\af0\dbch\af12\loch\f0 ies that the dec}{\dbch\af12\insrsid5588218\charrsid275711 \hich\af0\dbch\af12\loch\f0 e}{\dbch\af12\insrsid11221321\charrsid275711 \hich\af0\dbch\af12\loch\f0 ased was killed by shooting by a gun by a soldier of UPDF on 17.08.2005 at Akor Primary School, Lira District. \par }{\dbch\af12\insrsid5588218\charrsid275711 \par \hich\af0\dbch\af12\loch\f0 The deceased on the fateful day, while with PW1 at about mid-day, while bicycling}{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid5588218\charrsid275711 \hich\af0\dbch\af12\loch\f0 stopped at Abim Army detach to see an alleg\hich\af0\dbch\af12\loch\f0 ed thief who had been arrested and taken to the detach. \par \hich\af0\dbch\af12\loch\f0 At the army detach the two, }{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 and }{\dbch\af12\insrsid5588218\charrsid275711 \hich\af0\dbch\af12\loch\f0 other members of public, were dispersed by UPDF soldiers. They bicycled away}{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 towards Akor Primary School. }{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 They }{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 were being chased by some UPDF soldiers. The tyre of t\hich\af0\dbch\af12\loch\f0 heir bicycle burst; so that they had to run while at the same time pulling their bicycle.}{ \dbch\af12\insrsid14812192\charrsid275711 \par }{\dbch\af12\insrsid8340503\charrsid275711 \par \hich\af0\dbch\af12\loch\f0 At Akor Primary School, one of the chasing UPDF soldiers loudly called upon the UPDF soldiers guarding the school that PW1 and the deceased, were rebels. On hearing\hich\af0\dbch\af12\loch\f0 \hich\f0 this one of the UPDF soldiers, guarding the school, got a gun and shot the deceased. PW1 and PW2, then a cook at Akor Primary school, saw the shooting. PW2 used in vain her Kitengi\'94\loch\f0 cloth to try to stop the bleeding from the deceased. So}{ \dbch\af12\insrsid12154919\charrsid275711 \hich\af0\dbch\af12\loch\f0 o}{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 n thereafter t\hich\af0\dbch\af12\loch\f0 he deceased died. His father, PW3, was informed of the tragedy. He took the body to Lira Hospital for }{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 a }{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 post mortem examination and Report by PW4}{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 . He }{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 later buried the deceased, the burial being attended by senior UPDF officers as per the photographs. E\hich\af0\dbch\af12\loch\f0 xhibit P3. The officers regretted the death of deceased caused by their own UPDF sold}{ \dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 i}{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 er. \par \par \hich\af0\dbch\af12\loch\f0 On the basis of the above uncontroverted evidence, this Court holds tha}{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 t the plaintiff has established, on a balance of probabilities, }{ \dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 that the deceased was killed \hich\af0\dbch\af12\loch\f0 on 17.08.2005 as a result of shooting by servants/agents of defendant. The second issue is so answered. \par \par \hich\af0\dbch\af12\loch\f0 The third issue is whether the plaintiff has suffered any damages, and if so, what is the }{\dbch\af12\insrsid12154919\charrsid275711 \hich\af0\dbch\af12\loch\f0 quantum}{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 . \par \par \hich\af0\dbch\af12\loch\f0 Special damages were pleaded by plaintiff and copi\hich\af0\dbch\af12\loch\f0 es of available receipts were tendered in court: exhibit P2 showing expenses for some of the items bought and paid for in respect of deceased \hich\f0 \rquote \loch\f0 s burial. For other expenses the receipts were not available. Court however believes plaintiff that he spent th\hich\af0\dbch\af12\loch\f0 i\hich\af0\dbch\af12\loch\f0 s money.}{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 }{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 The total sum claimed as special damages is sh}{\dbch\af12\insrsid7569029\charrsid275711 \hich\af0\dbch\af12\loch\f0 s}{ \dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 824, 500/=. This amount is awarded to plaintiff. \par \par \hich\af0\dbch\af12\loch\f0 As already stated earlier on in this judgment, the damages awardable to plaintiff }{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 are }{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 for loss of expectation of life of the deceased. These damage\hich\af0\dbch\af12\loch\f0 s are awardable for the loss of the prospective happiness of the person whose life is gone. \par \par \hich\af0\dbch\af12\loch\f0 In assessing d}{\dbch\af12\insrsid7569029\charrsid275711 \hich\af0\dbch\af12\loch\f0 a}{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 mages of this nature}{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid8340503\charrsid275711 \hich\af0\dbch\af12\loch\f0 }{\dbch\af12\insrsid7569029\charrsid275711 \hich\af0\dbch\af12\loch\f0 in case of a shortened life, of a minor like the deceased, Court has to be satisfied that the circumstances of the individual \hich\af0\dbch\af12\loch\f0 life were calculated to lead}{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 , }{\dbch\af12\insrsid7569029\charrsid275711 \hich\af0\dbch\af12\loch\f0 on a balance, to a positive measure of happiness of which the victim has been deprived by the defendant\hich\f0 \rquote \loch\f0 s unlawful act of causing death of the victim. If the character or habits of the individual were calculated to }{\dbch\af12\insrsid14371096\charrsid275711 \hich\af0\dbch\af12\loch\f0 lead }{\dbch\af12\insrsid7569029\charrsid275711 \hich\af0\dbch\af12\loch\f0 him t\hich\af0\dbch\af12\loch\f0 o a future of unhappiness or despondency, that would be a circumstance justifying a small award. The test is not whether }{\dbch\af12\insrsid6889426\charrsid275711 \hich\af0\dbch\af12\loch\f0 the deceased}{\dbch\af12\insrsid7569029\charrsid275711 \hich\af0\dbch\af12\loch\f0 had the capacity or ability to appreciate that his future life on earth would bring happiness. }{\dbch\af12\insrsid9634480\charrsid275711 \hich\af0\dbch\af12\loch\f0 The test is not subjectiv\hich\af0\dbch\af12\loch\f0 e, and the right sum to award depends of on an objective estimate of the kind of future on earth the victim may have enjoyed. No regard must be had to financial losses or gains during the period of which the victim has been deprived. The damages are in \hich\af0\dbch\af12\loch\f0 r\hich\af0\dbch\af12\loch\f0 espect of loss of life, not of loss of future pecuniary prospects. }{\dbch\af12\insrsid9253291\charrsid275711 \par \par }{\dbch\af12\insrsid9634480\charrsid275711 \hich\af0\dbch\af12\loch\f0 In case of a young person, these damages tend to be reduced because there is so much uncertainty about this young person\hich\f0 \rquote \loch\f0 s future that no confident }{ \dbch\af12\insrsid3093380\charrsid275711 \hich\af0\dbch\af12\loch\f0 estimate of prospective happiness can \hich\af0\dbch\af12\loch\f0 be made. A young person has as yet no settled prospects, has not yet passed the risks and uncertainties of childhood}{ \dbch\af12\insrsid9253291\charrsid275711 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid3093380\charrsid275711 \hich\af0\dbch\af12\loch\f0 and has}{\dbch\af12\insrsid9253291\charrsid275711 \hich\af0\dbch\af12\loch\f0 ,}{ \dbch\af12\insrsid3093380\charrsid275711 \hich\af0\dbch\af12\loch\f0 as yet}{\dbch\af12\insrsid9253291\charrsid275711 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid3093380\charrsid275711 \hich\af0\dbch\af12\loch\f0 not acquired an established character and firmer hopes to make his/her future more definite. The extent to which go}{\dbch\af12\insrsid788436\charrsid275711 \hich\af0\dbch\af12\loch\f0 o}{\dbch\af12\insrsid3093380\charrsid275711 \hich\af0\dbch\af12\loch\f0 d f\hich\af0\dbch\af12\loch\f0 ortune may probably attend to him/her becomes less incalculable. The compensation is not being given to the person injured, for that person is dead. Thus damages which would be proper for a disabling injury tend to be greater tha}{ \dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 n those for deprivation o\hich\af0\dbch\af12\loch\f0 f life.}{\dbch\af12\insrsid8340503\charrsid275711 \par }{\dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 The principal function of awarding damages for loss of expectation of life is to provide an indirect way }{\dbch\af12\insrsid9253291\charrsid275711 \hich\af0\dbch\af12\loch\f0 to award }{\dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 damages for bereave}{\dbch\af12\insrsid10948964\charrsid275711 \hich\af0\dbch\af12\loch\f0 ment particularly in the Uganda}{\dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 Context, because under the common law, no claim for solitude or bereavement could b\hich\af0\dbch\af12\loch\f0 e entertained: }{\b\ul\dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 See Uganda Electricity Board vs. G. He stayed with his peasant parents at Anyer Parish, Adek okwok, Erute County, Li\hich\af0\dbch\af12\loch\f0 ra District. He was aged 15 yea}{\dbch\af12\insrsid10948964\charrsid275711 \hich\af0\dbch\af12\loch\f0 r}{ \dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 s. He was studying in Senior One at Nile High School. There is no evidence that he was to live an unhappy prospective life. He was happily living with his parents and the fact that at the age of 15 years, he was already \hich\af0\dbch\af12\loch\f0 in senior one, points to the possibility that deceased would have developed into a useful citizen as an adult, during the life expectancy in Uganda which varies between 42 and 55 years. \par \par \hich\af0\dbch\af12\loch\f0 In the case of }{\b\ul\dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 Uganda }{\b\ul\dbch\af12\insrsid7411616\charrsid275711 \hich\af0\dbch\af12\loch\f0 Electricity}{ \b\ul\dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 Board vs. G. W. Musoke (Supra)}{\b\ul\dbch\af12\insrsid7411616\charrsid275711 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid7411616\charrsid275711 \hich\af0\dbch\af12\loch\f0 the}{\dbch\af12\insrsid7411356\charrsid275711 \hich\af0\dbch\af12\loch\f0 deceased was aged 14. He died}{\dbch\af12\insrsid7411616\charrsid275711 \hich\af0\dbch\af12\loch\f0 as a result of stepping on a live electric wire negligently exposed on}{ \dbch\af12\insrsid9253291\charrsid275711 \hich\af0\dbch\af12\loch\f0 t}{\dbch\af12\insrsid7411616\charrsid275711 \hich\af0\dbch\af12\loch\f0 he ground by defendant. Shs. 1,000,000/= was awarded by the Supreme Court as general damages for loss of expectation of life. This was 15 years ago. \hich\af0\dbch\af12\loch\f0 Since then inflation has eaten into the value of the shilling. Taking into consideration all relevant matters, this court awards shs. 8,000,000/= general damages to plaintiff for loss of expectation of life.}{\dbch\af12\insrsid7411356\charrsid275711

\par \par }{\dbch\af12\insrsid7411616\charrsid275711 \hich\af0\dbch\af12\loch\f0 As to the claim for exemplary damages, court i\hich\af0\dbch\af12\loch\f0 s not satisfied that this is one of the cases where such damages are recoverable by the plaintiff.
