The delay in obtaining the record cannot save the appeal under Section 79(2) because the application for the record was made after the time for appealing had already expired. The court found no valid appeal before it and held that strict compliance with statutory time limits is required. The appeal was therefore struck out as incompetent, with costs awarded to the respondent.
