The trial in the lower court was a nullity because the defendant was not served with the amended plaint nor given an opportunity to respond to the claims of the additional plaintiffs, and only the defendant was recorded as having given evidence on oath, while other witnesses were not sworn. These procedural irregularities violated section 137 of the Evidence Act and the principles of fair trial. The appellate court cannot re-evaluate evidence where the record is fundamentally defective. Accordingly, the appeal is allowed, the judgment of the lower court is set aside, and a retrial is ordered before a competent court other than the original trial magistrate.

There is no such evidence before court. \par \tab Given the state of affairs as to how the trial was conducted in the lower court, this court allows this appeal, on the ground that the }{\insrsid14888967\charrsid12743307 trial below was }{\insrsid11346158\charrsid12743307 nullity}{ \insrsid14888967\charrsid12743307 .
