The appeal was filed out of time, as it was entered 118 days after the date of the decree, contrary to the mandatory thirty-day period stipulated by Section 79(1)(a) of the Civil Procedure Act. Although the appellant obtained leave to file out of time from the trial court, the law requires that such leave be sought from the appellate court. The failure to obtain leave from the proper court rendered the appeal incompetent. The resolution of this issue was dispositive, and the court did not address the second ground regarding the mode of institution. Consequently, the appeal was dismissed as being incompetent, and costs were awarded to the respondent.
