Ratio Decidendi

The Complainant was detained for 14 days by police officers, far in excess of the 48-hour constitutional limit for bringing an arrested person before a court. The police lock-up register corroborated the Complainant's account, and the Respondent failed to present any evidence to the contrary. The detention was therefore unlawful and constituted a violation of the Complainant's right to personal liberty under Article 23(4)(b) of the Constitution. The police officers acted within the scope of their employment, making the Attorney General vicariously liable. The Complainant is entitled to compensation for the violation, and general damages are awarded based on the period of illegal detention.
