The court found that neither Gulu Municipal Council nor Pece Division Local Council had the legal capacity to appoint the plaintiffs as teachers or caretaker head teacher, as the power to appoint persons to office in the service of a district or urban council is vested exclusively in the District Service Commission under section 55(1) of The Local Governments Act. The purported contracts of employment were ultra vires the powers of the defendants and therefore void and unenforceable. The plaintiffs, having constructive notice of the statutory limitations, could not rely on ostensible authority or estoppel to validate the appointments.
