The court found that while the Claimant fundamentally breached his obligations as Secretary Manager and Accounting Officer, justifying summary dismissal under Section 69 of the Employment Act, the Respondent failed to comply with the procedural requirements of Section 66. Specifically, after the investigation, the Claimant was not given an opportunity to respond to the findings in a disciplinary hearing before termination. The Respondent's own terms of service also required such a process. As a result, the dismissal was substantively lawful but procedurally improper.
