The Court of Appeal held that as a second appellate court, it is limited to matters of law and cannot disturb concurrent findings of fact by the trial and first appellate courts unless special circumstances justify it. The court found that both lower courts properly evaluated the evidence and concluded that the respondent acquired the suit land by gift inter vivos from Oiko Mikaya. The appellants' grounds relating to questions of fact were struck out as they offended Section 72 of the Civil Procedure Act. The court found no illegality or special circumstances warranting interference with the findings and upheld the decisions of the lower courts, dismissing the appeal with costs.
