The court held that the so-called 'Tentative Memorandum of Appeal' filed by the appellants met all the substantive requirements of Order 43 rule 1 of the Civil Procedure Rules, as it was filed within time, set out the grounds of appeal concisely and under distinct heads, and was relied upon by the appellants as their memorandum of appeal. The mere use of the word 'tentative' was a misnomer and not a fatal defect.
