Ratio Decidendi

The Court of Appeal held that a second appeal is restricted to questions of law, and that only ground 2 of the appeal, concerning the application of the Limitation Act, raised a point of law. The Court found that the right of action for recovery of land accrues when the plaintiff becomes aware of the trespass, which in this case was 2006, not 1982 as argued by the appellant. The suit was therefore not time-barred. The Court also struck out ground 1 of the appeal for being too general and not complying with the procedural requirements for grounds of appeal. The appeal was dismissed and the decision of the High Court was upheld.
